Terms of Use

Effective date 2026-10-04

This is a translation; the Turkish text is binding. Kullanım Koşulları (Türkçe)

These terms govern your use of the Kararis platform operated by Zehra Eslem Karaca (04.09 Digital) ("Kararis", "we"). By signing in to the platform or by accepting an invitation link, you accept these terms. The version you accepted is recorded.

1. Scope and parties

Kararis is currently offered as agency-managed: an agency uses the platform, sets up the platform connections itself and brings its own client onto the platform by invitation.

These terms govern how the user who opens an account by invitation may use the platform. The commercial relationship between the agency and its own client — scope of service, fee, term and termination — is not the subject of this document and remains in the separate contract between those parties. This document does not replace or amend that contract.

2. Definitions

3. Account and access

a. An account can only be opened with a time-limited, single-use invitation link. There is no open registration.

b. Your password must be at least 12 characters long. You are responsible for the security of your account and your password; your account may not be shared with or transferred to anyone else. If you notice any unauthorized use, you must notify us without delay.

c. Your access is limited to the role and scope of your membership. A user with a selected brand scope cannot access reports belonging to the organization as a whole; this boundary is enforced in the core of the application, not in the interface.

d. When your membership is deactivated or your scope is changed, your access narrows accordingly and immediately.

4. Nature of the service — what it does and does not do

a. Kararis is a decision support tool. The findings and recommendations it produces are for information purposes. You make the decision, and you are responsible for the outcome of the decision you make.

b. Kararis does not make changes to your advertising accounts on its own. It does not intervene autonomously in budget, bids, campaign status or creatives; connections are for reading.

c. No guarantee of results is given. No provision of this document may be interpreted as a commitment that your sales, conversions or advertising performance will increase.

d. Artificial intelligence is not the layer that produces the decision. The artificial intelligence layer that produces texts does not produce metrics, decisions or priorities; these are produced by a deterministic rule engine, and artificial intelligence only explains the evidence and translates it into the brand's language. Details are in the AI Provider Statement.

e. The limit of the measurement is shown. The platform does not present a place it cannot see as "clean"; it names an area that cannot be measured. Nevertheless, the accuracy of a measurement is limited by the accuracy of the data provided by the connected platform.

5. Your obligations

a. You connect to the platform only accounts that you are authorized to connect. If you connect a brand's data to the platform on its behalf, you are deemed to have declared that you are authorized to do so and that you have provided the required information to — and, where necessary, obtained consent from — your own client.

b. You comply with the terms of use of the connected platforms (Google, Meta, İkas, HotelRunner and others) and with the legislation in force. If a use contrary to those terms is detected, you will be asked to remedy the breach immediately.

c. You may use the reports and outputs you receive from the platform for the purposes of your own business and your own client. You may not resell them commercially or use them to develop a competing product without the written approval of Kararis.

d. Meta data. You do not process or operate the data that comes to the platform through the Meta (Facebook, Instagram) connection, and that reaches you from the platform through a report or by any other means, in a manner contrary to the Meta Platform Terms and the Meta Developer Policies. You are deemed to have accepted the Meta Terms of Service (including the Meta Advertising Standards), the Meta Commercial Terms and the Meta Self-Serve Ads Terms; if you connect a brand's Meta data on its behalf, you ensure that the brand has also accepted these terms. If Meta requests it on the grounds of a breach of these terms or of an adverse impact on Meta's Platform, its other products, Platform Data or the people who use its products, your access to Meta data through the platform may be cut off immediately; in that case the remedy period in Section 11 may not apply.

6. Prohibited uses

You may not do the following, and may not allow your authorized users to do them:

7. Anonymous benchmarking contribution

Contribution to the anonymous benchmarking pool is optional, is given at the organization level, is off by default and can be withdrawn at any time. The party that turns on the contribution confirms with a written statement that it has obtained this right from its own client; the statement, the person who turned it on and the time are recorded in an immutable ledger. Withdrawal is also entered in the ledger as a separate record.

Reciprocity: Benchmarking outputs are offered only to contributing organizations. Not contributing does not restrict your access to any part of the service; you simply do not see the benchmarking outputs. The data of an organization without a consent record does not enter any pool.

8. Intellectual property

a. All intellectual and industrial property rights relating to the platform, including the software, source code, rule engine, interface design, brand name and logo, belong to Kararis. These terms grant you only the right to use the platform; they do not involve any transfer of ownership or of a license.

b. The data coming from the accounts you connect to the platform and the reports built on it are your data and your client's data. We claim no right over this data other than to provide the service to you.

c. We may use your name, brand or logo as a reference only if you give separate and explicit permission.

9. Continuity of the service

There may be planned maintenance and unforeseeable interruptions. We try to announce planned interruptions in advance to a reasonable extent. The service is provided "as is"; it is not promised that it will operate without interruption or without errors.

10. Limitation of liability

To the maximum extent permitted by the legislation in force:

These limitations do not cover our liability arising from our intent or gross negligence, nor liabilities that cannot be limited under the legislation.

11. Suspension and termination

a. If a use contrary to these terms or to the terms of the connected platforms is detected, we may suspend or terminate your access. Where the nature of the breach allows, we first give a reasonable period for remedy; in situations that create a security risk, suspension may be applied immediately.

b. What happens to the data if your access ends is set out in the Data Retention and Deletion Policy.

12. Fees

In this version no fee is charged to you directly for the use of the platform. Pricing between the agency and its client is outside this document. Should direct charging be introduced in the future, the terms will be announced with a new version and you will be informed before it takes effect.

13. Personal data

The processing of personal data is governed by the Privacy Policy, the KVKK Information Notice and the Data Retention and Deletion Policy. All of these documents form an integral part of these terms.

14. Changes

Every version of these terms carries a version number and an effective date. We give advance notice of material changes. The publication of a new version does not retroactively change the approval you gave to an earlier version and does not by itself close your access.

Version note (1.1). The operator and data controller of the platform has been updated to Zehra Eslem Karaca (04.09 Digital), and the contact address has been written out in full as the business address in the tax record. The other provisions did not change.

Version note (1.2). A Meta data clause (d) was added to Section 5: the processing of Meta data in accordance with the Meta Platform Terms and Developer Policies, the acceptance of the Meta Terms of Service, Advertising Standards, Commercial Terms and Self-Serve Ads Terms, and the possibility of access being cut off if Meta requests it. The operator identity and contact information are as in 1.1. The other provisions did not change.

15. Governing law and jurisdiction

These terms are governed by Turkish law. The Istanbul Courts and Enforcement Offices have jurisdiction over disputes. The statutory remedies available to you as a consumer are reserved.
